Your story on the Brookswood/Fernridge tree-cutting bylaw is misleading.
The bylaw reads, “Despite any other provisions of this Bylaw, a person may remove up to the lesser of: (i) 8 Trees, or (ii) 20 per cent of the Trees, from a Parcel… in addition to any Trees permitted to be removed under section 6.
“(2) Without limitation, every person, including the Owner, is prohibited from removing more than (i) the lesser of:
“a. 8 Trees, or b. 20 per cent of the Trees, from a Parcel, from the date this Bylaw is adopted until the date it is repealed, or
“(ii) any other Trees from the Parcel except as permitted under section 6.â€
To cut down eight trees, they would have to have 40 trees on their property, as eight is 20 per cent of 40 – “the lesser of.â€
I hope you report this as soon as possible, before someone makes an error and incurs a $10,000 fine.
