Fewer trees means fewer allowed to be cut

 

Dear Editor,

Your story on the Brookswood/Fernridge tree-cutting bylaw is misleading. 

The bylaw reads, “Despite any other provisions of this Bylaw, a person may remove up to the lesser of: (i) 8 Trees, or  (ii) 20 per cent of the Trees, from a Parcel… in addition to any Trees permitted to be removed under section 6. 

“(2) Without limitation, every person, including the Owner, is prohibited from removing more than (i) the lesser of:  

“a. 8 Trees, or b. 20 per cent of the Trees, from a Parcel, from the date this Bylaw is adopted until the date it is repealed, or  

“(ii) any other Trees from the Parcel except as permitted under section 6.”

To cut down eight trees, they would have to have 40 trees on their property, as eight is 20 per cent of 40 – “the lesser of.”

I hope you report this as soon as possible, before someone makes an error and incurs a $10,000 fine.
